Stonewall responds to recent tribunal decisions

Published December 9, 2025

 A Stonewall spokesperson said:

Recent employment tribunal decisions show that the rights and dignity of all people, including trans people, must be given due and reasonable consideration.

The judgements show there is not, in law, a hierarchy of human rights.

The rulings indicate that a blanket ban on all trans women from women’s toilets and changing rooms will not necessarily hold up in court, and suggests that each situation should be dealt with on its merits.

This demonstrates the need for clear, practical guidance from the Equality and Human Rights Commission to ensure service providers and employers can move forward with confidence and that the law is applied in a fair and reasonable way for all.
